Who owns the photos, the photographer or the client?
Under default copyright law, the photographer who takes the image owns it. This template keeps it that way and grants the client a personal-use license, which is the standard arrangement for weddings and portraits. Full copyright transfer is possible but is normally negotiated for commercial work at a different price.
How much should the retainer be?
25-50% of the total fee is typical; many wedding photographers use a third. It compensates for turning away other bookings on that date, which is why this template treats it as non-refundable when the client cancels.
What happens if the photographer cancels?
The clause here refunds everything including the retainer, or offers a comparable substitute at the client's choice. An agreement that punishes only client cancellation reads as unfair for good reason.
